The second question of Fatwa No. ( 14837 )
Q2: Is it permissible for a husband to have intercourse with his wife before she performs the ritual bath for her menstruation?
A2: It is not permissible for a husband to have intercourse with his menstruating wife until she performs the ritual bath; because of the saying of Allah the Exalted:[Al-Baqarah 2:222] meaning when they have performed the ritual bath. This is how Ibn Abbas interpreted it; because Allah said: meaning: the harm is removed from them, which is the blood of menstruation, then He said: [Al-Baqarah 2:222] So He, Blessed and Exalted is He, made two conditions for the permissibility of the menstruating woman: the first condition is the cessation of the blood of menstruation, which is purification. The second condition is the ritual bath from menstruation, which is purification. Then He, Blessed and Exalted is He, praised those who adhere to His law, saying: [Al-Baqarah 2:222] . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
Q2: Is it permissible for a husband to have intercourse with his wife before she performs the ritual bath for her menstruation?
A2: It is not permissible for a husband to have intercourse with his menstruating wife until she performs the ritual bath; because of the saying of Allah the Exalted:
And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you.
Until they purify themselves
حَتَّى يَطْهُرْنَAnd when they have purified themselves, then come to them from where Allah has ordained for you
فَإِذَا تَطَهَّرْنَ فَأْتُوهُنَّ مِنْ حَيْثُ أَمَرَكُمُ اللَّهُIndeed, Allah loves those who are constantly repentant and loves those who purify themselves."
إِنَّ اللَّهَ يُحِبُّ التَّوَّابِينَ وَيُحِبُّ الْمُتَطَهِّرِينَ
