Q: I was married to a previous husband who was of bad character and consumed intoxicants. He treated me very badly. I had a daughter from him, then I became pregnant with a second child, and the relationship between us grew worse. One day
he came in and hit me in the stomach, causing me to bleed. I was six months pregnant. Given the bad character and treatment I was suffering from him, I used all kinds of drugs, both herbal and medical, to abort the fetus. After about fifteen days, the fetus was aborted in the sixth month, alive, and then died. What is the Islamic ruling on this? May Allah reward you with good?

A: First: Your action is reprehensible and a sin against Allah; because it is not permissible to abort the fetus, even if the husband mistreats you. You must repent to Allah (Glorified and Exalted is He) for this, by feeling remorse for what happened and resolving not to return to such an act. Second: You must repent to Allah (Glorified and Exalted is He) for this bad action; because it is not permissible to cause the abortion of the pregnancy. Aborting it in such a situation is considered one of the major sins. You owe blood money (diyah) and expiation (kaffarah), which is freeing a slave. If you cannot find one, then fasting for two consecutive months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
