Q: My grandmother (may Allah have mercy on her) passed away about seven years ago, and we heard a few months ago that forty years ago she was pregnant and did not want the pregnancy, so she carried heavy weights until she miscarried. It is not known whether she asked about it afterward or not. She was likely ignorant of the ruling on intentional abortion because she lived in the desert, and all of her children, both sons and daughters, say: We never heard of this pregnancy from her before, except one daughter who says: I heard about it, and it was a boy, but it is not known how old the fetus was at the time of the abortion. The woman who gave us this information, they say, was ill from the previous pregnancy, and that is what led her to abort this fetus. In this case, what is the ruling on her abortion? And what fasting or expiation is required of her?
A: What the questioner’s grandmother did by aborting her pregnancy was done intentionally and deliberately to kill, and there is no expiation for it according to the correct opinion of the scholars, because the sin is too great for an expiation to cover it. Based on this, it is not prescribed for the heirs of
this woman to fast on her behalf, since no expiation was obligatory upon her. Furthermore, it has not been established that this abortion occurred after the soul was breathed into the fetus, and expiation is only obligatory for an accidental abortion after the soul has been breathed into the fetus.
