Q: A man came across a rabbit on his path, so he threw a stick or a stone at it and mentioned the name of Allah, and it died, but its soul did not depart. Is it permissible for him to eat it? And if it is forbidden, what is the reason for its prohibition? Likewise: A man encountered game, caught it, mentioned the name of Allah, and struck it with stones or a stick until it died. Is it permissible for him to eat it? And if he slaughtered it with a tooth or a nail, is it permissible for him to eat it? Also, my grandfather (my father's father) used to say: We used to throw stones and sticks at game and mention the name of Allah, and we would eat what we caught. Was his action correct?

A:The game that is killed in the manner described in the questions, by a stone or a stick, if that is done with the broad side of the stone or the stick, then it is not permissible to eat it; because it was killed by a heavy object, not by a sharp one. It is a condition in the instrument used for hunting that it be sharp and cuts the blood; due to the saying of the Prophet (peace and blessings be upon him):
If the killing tool causes blood to gush out and if Allah's Name is mentioned, eat (of the slaughterer animal). But do not slaughter with a tooth or a nail.ما أنهر الدم، وذكر اسم الله عليه فكل، ليس السن والظفر

agreed upon by al-Bukhari and Muslim. And it is established from the Prophet (peace and blessings be upon him) the prohibition of eating from game that is killed by a heavy object; because it is a hunted animal killed by weight, so from'Adi(may Allah be pleased with him) he said:
I asked the Messenger of Allah (peace and blessings be upon him) about the game of the mura'id, and he said: If it hits it with its sharp edge, eat it. If it hits it with its side, it is a strangled animal, so do not eat it.سألت رسول الله صلى الله عليه وسلم عن صيد المعراض فقال: إن أصابه بحده فكل، وإن أصابه بعرضه فإنه وقيذ فلا تأكل
. It was narrated byal-Bukhari. And the mura'idAs He saidIbn Qudamah: (a pointed stick, sometimes with an iron tip attached to its head, saidAhmad: the mura'id is like an arrow; it is thrown at the game, and sometimes it hits the game with its point, piercing and killing it, in which case it is permissible; and sometimes it hits with its side, killing it by its weight, in which case it is considered a wuqiyadh (killed by weight) and is not permissible) End of quote.(Al-Mughni 13: 282).
However, if the hunter catches the game alive after it has been hit by the hunter with the mura'id or other heavy objects, and he slaughters it, it is permissible due to the saying of Allah the Exalted:
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death]حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالدَّمُ وَلَحْمُ الْخِنْـزِيرِ وَمَا أُهِلَّ لِغَيْرِ اللَّهِ بِهِ وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ إِلا مَا ذَكَّيْتُمْ
[Al-Ma'idah 5:3]

But if something of what the hunter used, such as a stone or a stick, has a sharp edge and hits the game with its sharp edge, and it dies from that, then it is permissible to eat what was hit by it; due to the hadith of 'Adi mentioned earlier regarding the mura'id.
