Questions one, three, four, five, six, eight, and twelve from Fatwa number ( 17883 )
Q 1: What is the ruling of the Shari'ah regarding placing the deceased in a sealed casket after shrouding him and placing it in the grave ?
A 1: The Sunnah is not to bury the deceased in a casket; because the Prophet (peace and blessings be upon him) did not do so, nor did the Companions after him. However, what is prescribed is to shroud him in three white garments and place him in a niche in his grave.
Q 3: What is the ruling of the Shari'ah regarding burying a husband and wife in the same grave if they die at the same time ?
A 3: The ruling on burying a husband and wife in the same grave is not permissible except in the case of
need, such as when there are many deceased due to a disease, battle, or the like. In that case, it is permissible to bury two, three, or more in one pit, as the Prophet (peace and blessings be upon him) did with the martyrs of Uhud.

Q 4: What is the ruling of the Shari'ah regarding digging up a wife's grave to bury her husband next to her if he bequeathed it, and what are the cases in which it is permissible in the Shari'ah to dig up a grave?
A 4: It is not permissible to dig up a wife's grave in order to bury her next to her husband, even if he bequeathed it.
Q 5: What is the evidence from the Book and the Sunnah that the dead hear the sound of the sandals of those who accompany them to the grave, and what is the evidence from the Book and the Sunnah that the dead see those who visit them? If that is the case, what are the preferred times for visiting graves, specifically the times when the dead see those who visit them?
A 5: It is established in (the two Sahihs) that the deceased hears the sound of the sandals of those who accompany him after burial when they return from the cemetery. So, from Anas (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said:
When a man is placed in his grave and his friends leave him, he hears the beat of their sandals. Then two angels come to him and, having made him sit up, they say, ‘What was your opinion of this man, of Muhammad?’ The believer replies, ‘I testify that he is God’s servant and messenger.’ He is then told to look at his abode in hell for which God has substituted for him an abode in paradise, and he sees them both.
Mishkat al-Masabih 126Muttafaqun 'alayh (Zubair `Aliza'i)
Qatadah said: And it was mentioned to us that he is given space in his grave. Then he returned to the hadith of Anas and said:
The hypocrite and infidel are asked, ‘What was your opinion of this man?’ and reply, ‘I do not know; I held the opinion others held.’ They will retort, ‘You neither knew nor did you follow [the believers].’ He will then be given a blow with iron hammers and will utter a shout which will be heard by all who are near him, with the exception of men and jinn.
Mishkat al-Masabih 126Muttafaqun 'alayh (Zubair `Aliza'i)
. There is no text specifying a particular time for visiting the dead; rather, the Prophet (peace and blessings be upon him) gave a general command to visit graves for the sake of remembrance and admonition, saying:
I used to forbid you to visit the graves, but now visit them, for they remind you of the Hereafter.
Musnad Ahmad 1236, 1237Sahih, because of corroborating evidence; this is a da'eef isnad because of the weakness of Ali bin Zaid and Rabee'ah bin an-Nabighah and his father are unknown], Sahih because of corroborating eviden (Darussalam)
. There is no text from the Prophet (peace and blessings be upon him) clarifying that the dead see those who visit them, as far as we know. The original ruling is that they do not, except with evidence. The original ruling is also that the dead do not hear the speech of the living, except with specific evidence, such as the hadith of Anas mentioned above; due to the saying of Allah, the Exalted:
but you cannot make hear those in the graves.
[Fatir 35:22]
, and His saying, the Exalted:
Indeed, you will not make the dead hear
[An-Naml 27:80]
the verse.
