Q: We inform your Excellency that the citizen Ahmad Musa Kharimi submitted a petition to the municipality, registered with us under number (2105) on 17/6/1417 AH, stating that he is acting in the cause of Allah the Exalted by removing the thorn trees and acacias located in the Bish cemetery . Given the sanctity of the deceased, we would like your Excellency to review the matter and guide us on what you consider the Sharia-compliant approach, so that we may approve the request and assist him in moving them from outside the cemetery walls, should your Excellency approve.
A : If the presence of the aforementioned trees and thorn trees harms the cemetery or the people during burial or when visiting graves due to their thorns or the like, there is no harm in removing them to eliminate the harm, provided that the removal is carried out by the municipality or under its supervision, using hand tools, and in a manner that does not harm the deceased or affect the graves through desecration or the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
