Q35: What is our position when the scholars disagree?
A35: One who is qualified with Islamic knowledge and is aware of the methods of derivation and preference from the Book and the Sunnah, and what is required for that, should not adhere to a specific school of jurisprudence, but rather take what is supported by evidence. As for one who is unable to know the ruling with its evidence, or the evidences are similar to him, or preference is difficult for him, or his time is too short to allow for that, he should ask one known for knowledge, piety, insight, and experience in issuing fatwas, as Allah the Exalted said:[An-Nahl 16:43], and act on what he is told, or read what the people of his country rely upon from the books of one of the four famous schools of jurisprudence, and take from it, study it, and issue fatwas based on it, as long as there is no anomaly in it that contradicts the Book and the Sunnah.
