Is it permissible to sell a musyarrah?

Machine translationRead the Arabic original
The questioner : In our country, it is customary that when a person wants to sell a type of female livestock that has milk, they withhold the milk in the udder of the animal for two or three days before taking it to the market to sell it, so that the buyer is deceived by its appearance and buys it for an inflated price. Is this permissible or not?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and all his Companions. This practice is not permissible. I mean, when a person wants to sell a milch animal, he prevents it from being milked for two or three days until its udder becomes full, thereby deceiving the buyer. This is a forbidden act because the Prophet (peace and blessings be upon him) prohibited it in his saying:
Do not withhold the milk of camels or sheep. لا تصر الإبل والغنم
. Al-Tasriyah is withholding the milk in the udder of the animal so that it is thought to have a lot of milk. This is falling into what the Messenger (peace and blessings be upon him) prohibited. It is also a form of deception, because this is deceiving your Muslim brother. And the Prophet (peace and blessings be upon him) said:
Whoever cheats, he is not one of us. من غش فليس منا
Jami` at-Tirmidhi 1315Sahih (Darussalam)
. It is also contrary to the perfection of faith, as the Prophet (peace and blessings be upon him) said:
None of you will have faith till he wishes for his (Muslim) brother what he likes for himself. لا يؤمن أحدكم حتى يُحب لأخيه ما يحب لنفسه
Sahih al-Bukhari 13
. It is known that you do not like for yourself to be deceived by such a deception. So if you do not like that for yourself, how can you like it for your believing brother? Thus, you have loved for your brother what you do not love for yourself, and the perfection of faith is negated from you. In this practice, there are three harms: falling into what the Messenger (peace and blessings be upon him) prohibited, falling into what the Prophet (peace and blessings be upon him) disavowed, and a deficiency in faith. So the believer who is mindful of his Lord should make his buying and selling explicit and clear, so that he may be blessed in it, as the Prophet (peace and blessings be upon him) said:
The two parties in a sale have the option. If they speak the truth and make it clear, they will be blessed in their sale. If they lie and conceal, the blessing of their sale will be erased. البيّعان بالخيار فإن صدقا وبيّنا بورك لهما في بيعها وإن كذبا وكتما مُحِقت بركة بيعهما
.

The questioner : The question...

The Shaykh : Then.

The questioner : Yes.

The Shaykh : The buyer who purchased this musyarrah animal has the option after he milks it for three days. If he wishes, he may keep it, and if he wishes, he may return it along with a sa' of dates. Yes.
