Prohibition of Deception in Sales

Machine translationRead the Arabic original
Question: We work in raising livestock and trading in it, and sometimes some of the sheep or camels get sick, so we sell them in the markets while they are afflicted with that disease. Do we have any obligation regarding this?

Answer: Buying and selling are among the things Allah the Exalted has made permissible for His servants, and they are the foundation of their interests and benefits. However, buying and selling must be based on truthfulness, trustworthiness, and sincere advice. The Prophet (peace and blessings be upon him) said:
Both parties in a business transaction have the right to annul it so long as they have not separated; and if they speak the truth and make everything clear they will be blessed in their transaction; but if they tell a lie and conceal anything the blessing on their transaction will be blotted out.البيعان بالخيار ما لم يتفرقا فإن صدقا وبينا بورك لهما في بيعهما، وإن كذبا وكتما محقت بركة بيعهما
Sahih Muslim 1532a
, and the Prophet (peace and blessings be upon him) forbade deception,And he said:
Whoever cheats, he is not one of us.من غش فليس منا
Jami` at-Tirmidhi 1315Sahih (Darussalam)
،And he said:
Do not bid against one another, do not sell to one who is already in a transaction, and do not let some of you sell on the sale of others. A Muslim is the brother of a Muslim.لا تناجشوا ولا تدابروا، ولا يبع بعضكم على بيع بعض، المسلم أخو المسلم
Sunan al-Bayhaqi 7:24
, and there are many hadiths on this matter. If you sell a commodity that has a defect, it is obligatory for you to disclose it to the buyer, and you must not conceal it or deceive him about it. Therefore, these sheep that you are selling, which have a disease, you must disclose the disease they have, and sell them as defective, and inform the buyer of what is in them, so that your sale is based on truthfulness and not concealment.
