Fatwa No. ( 15570 )
Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet
After this: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency the Deputy Governor of the 'Asir Region, bearing reference number (10557) and dated 18/2/1413 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars, bearing reference number (930) and dated 25/2/1413 AH. His Excellency requested a ruling on the removal of two of the mosques clustered near each other in Bisha , and attached to his letter is the report of the committee formed to examine the aforementioned mosques, the text of which is as follows: We, each of us from the representative of the Bisha Court, the Municipality, the Endowments, and the Police, went out and inspected the site. We found that there are three mosques close to each other as follows: 1- The mosque built by (Th. 'A. D.) is affiliated with the Endowments, built on land granted to the Endowments, with a deed number (17) dated 22/2/1412 AH, and is considered an official mosque. 2- Next to it are two mosques: the first is built on the property of the one named ('A. R), and only the public asphalt road leading to al-Hazimi separates them. The second is a structure made of zinc on municipal land, located approximately one hundred meters from the aforementioned Endowments mosque.
3- There is a small mosque built on the property of (M. M. M), located approximately 500 meters from these mosques. The Committee's Opinion: The Committee, and the opinion belongs to Allah and then to the rulers, holds that the mosque built by the citizens on municipal land should be removed, as it is close to the government mosque. The one named ('A. R) should lock the mosque on his property and remove it, as it overlaps with the house of the aforementioned individual. The mosque built on the property of Munis should remain in its current state, as it is far from the government mosque and serves an independent neighborhood. The residents and neighbors should be informed that they must perform the prayer in the Endowments mosque built by (Th. 'A. D) in order to unify the congregation and prevent their division. May Allah grant success. The Honorable Head of the High Court in Bisha also held this view in his letter addressed to the Governorate of Bisha , number (80\1) and dated 4/1/1413 AH, the text of which is as follows: We inform you that as long as there is a mosque with deed number (17) dated 22/2/1412 AH, which was built by (Th. 'A), it should remain. As for the two mosques that are only one hundred meters away from it, namely the one in the property of 'Abd al-Rahman ibn Rukban and the one on municipal land, they should be removed, and their owners should be required to pledge to pray in the fourth Endowments mosque; because it is not permissible to place a mosque next to another except out of dire necessity. As for the mosque at (M. M. M), given its distance from the old mosque
it should remain for prayer as long as the distance is five hundred meters (half a kilometer). We hope you will review this and instruct those concerned. May Allah protect you.
