Q: We are in the mosque of Prince Salman ibn Muhammad Al Saud , and we are suffering from the smallness of the mosque and its inability to accommodate the worshippers. There is no place for the women in Ramadan. We used to set up a large tent for the women in Ramadan every year, and that was on the land behind the mosque. This tent was exposed to the gathering of cats, the mischief of children, and the accumulation of rain on
top of it, not to mention the security danger of someone exposing himself to the women. So we looked for the owner of the land to buy it from him, but we did not find him. We placed an advertisement on the land stating that it is needed, but no one responded to us. An idea was presented to us, which is: to place a temporary structure made of iron, which has no foundations in the ground, so that we can benefit from it by placing a prayer place for the women, and we can also benefit from it in other things. If the owner of the land comes, either he will sell it to us or we will vacate it for him. We presented this matter to the sons of the Prince, and they told us that they support this matter, but they need a fatwa regarding it. It is known that the land has not been developed before, and if it had an owner or if its owner needed it, we would have found him after the search exhausted us. So we ask you to issue a fatwa on this issue, and may Allah reward you with good.
A: The principle is that people’s private rights are not permissible for anyone to build upon or otherwise, or to benefit from without their permission. You must look for an alternative to this land. Also, establishing a prayer place outside the boundaries of the mosque, where the worshippers inside it cannot see the imam, is not permissible for the one praying in it to follow the imam. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
