The one in dire necessity prays in a mosque containing a grave when he finds no other

Machine translationRead the Arabic original
The first question of fatwa number ( 18224 )
Q 1: What should one do if he finds himself in dire necessity to pray in mosques that have graves in them, behind them, or beside them? Knowing that these graves have been there for a long time, are no longer remembered, and there is no mosque in that neighborhood or village except that one?
the neighborhood or the village, except for that?

A 1: It is not permissible to pray in mosques that contain graves; because the Prophet (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
agreed upon by al-Bukhari and Muslim, and his saying (peace and blessings be upon him):
Do not pray toward graves and do not sit on them.لا تصلوا إلى القبور ولا تجلسوا عليها
Sunan an-Nasa'i 760Sahih (Darussalam)
narrated by Muslim in (his Sahih), and because that is a means to associating partners with Allah with the people of those graves, and worshipping them along with Allah (Glorified and Exalted is He). And whoever does not find a mosque except this mosque built over the grave, he should pray in another place free of graves, for the earth of Allah is vast, and the Prophet (peace and blessings be upon him) said:
the earth has been made for me a place of worship and a means of purification.جعلت لي الأرض مسجدًا وطهورًا
Sunan Ibn Majah 567Sahih (Darussalam)
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
