Q 5: Next to our house is a date palm. It is harmful; its leaves fall inside the house, its branches extend into the house, and the insects bother us. O honorable Shaykh: Is it permissible to cut it? Please rule for us, may Allah reward you with good.
A 5 : There is no harm in cutting a harmful tree or removing it; due to the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 2340Da'if (Darussalam) And if it is in private ownership, one must seek the owner's permission to remove it. As for what hangs over into the property of another or into the road, and is harmful, there is no need to seek permission to remove the hanging part and the harmful part in the road. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
