Q: One of my friends married a woman and had a daughter with her, then he divorced her. The daughter stayed with her mother until she reached the age of 16. In the year 1420 AH, he asked me to intercede to request the daughter so that she could go with him to his home in the city of Jeddah, because he was unable to request her himself; for he had not provided for her during the time she was with her mother. He asked to have his daughter for one month of the vacation and then return her to her mother. At that time, I went to her mother's family and spoke to them about this matter. Her mother asked me for a pledge that her daughter would return to her after the end of the month. I actually called the daughter's father and informed him of this, and he said to me: I pledge to you by Allah that I will return her
to her mother, even if she were dead. At that point, I stood up and gave the daughter's mother a pledge by Allah according to his promise to me. But unfortunately; the aforementioned person, after the end of the specified period, refused to return the daughter to her mother. Since the mother was suffering from a heart condition, she passed away in the hospital in the month of Dhul-Hijjah of the year 1420 AH, and the daughter is still with him until now. My question, O honorable Shaykh: 1 - What is incumbent upon me for uttering the pledge and not fulfilling it, when that was beyond my capacity, and I did everything in my power with the aforementioned person but to no avail, and he did not respond to it? 2 - I have boycotted the aforementioned person in all aspects, as there is no telephone contact or visit between me and him; because he broke the pledge between me and him. Is there anything upon me for that? Knowing that he is not a close relative. I hope from Allah, then from your honor, to inform me about this matter, and what is incumbent upon me regarding it. May Allah reward you with good?
A: It is obligatory for you to pay the expiation for an oath, which is: feeding ten poor people, with each poor person receiving one and a half kilograms of food, or clothing ten poor people, with each poor person receiving a garment, or freeing a believing slave. If you are unable to do so, it is obligatory for you to fast for three days.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
