Q1: My wife told me about two months before her passing that she had a vow to slaughter a cow. I asked her about the reason for her vow, and she said that she was being harassed by one of her brothers because he was opposed to her marriage to me and was mistreating her. She mentioned that she had said, due to her brother's harassment: "If I leave my parents' house and move to my husband's house, I will slaughter a cow." And indeed, O Shaykh, she did leave, and I married her, and she bore me two children. In the last weeks of her life, may Allah have mercy on her, she said to me: "I have a vow to slaughter a cow, and I must fulfill my vow." Her financial situation at that time was poor, and her health was extremely bad, as I took her to hospitals for treatment until she passed away. I told her, O Shaykh, in the last days of her life: "Now you know that my circumstances do not allow me to fulfill your vow, but ask Allah the Exalted for healing, and if you are still alive, I will fulfill your vow when the financial circumstances improve, and if you pass away, I will fulfill your vow." I said this with a sincere intention. Knowing, O Shaykh, that
she asked me to distribute it among the poor. I hope for your ruling, Your Eminence: Is the vow my wife made binding on me? And what is the value of the cow? Please rule for us, may you be rewarded, and may Allah reward you with the best reward. Q2: I was in debt for a sum of money, and I asked my wife to give me some of her jewelry so I could pay the amount owed to me. I told her: "I will return it to you in the future, if Allah wills," but I was unable to return the amount to her. When I speak to her about it, she says: "There is nothing between you and me, and I did not ask you to return the jewelry to me." My wife has passed away, may Allah have mercy on her, and I have a daughter from her who is four years old and a son who is two years old. I want, O honorable father, to be absolved of my liability. A1, 2: You are required to slaughter the cow that your wife vowed to slaughter and died before fulfilling, if the value of the jewelry you borrowed from her reaches the value of the cow, or if she has an estate that completes that amount. However, if it does not reach the value of the cow and she has no estate other than that, it is better that you complete it from your own wealth and slaughter the cow; to fulfill the promise you made to her in her lifetime, and because fulfilling the vow was obligatory upon her; for the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 6696 .
