Q7: A mosque has a grave behind it, and there is a wall between it and the mosque. Is it permissible to pray in the mosque? Is the prayer in it invalid or not? What is the ruling on one who swears by other than Allah, such as the Prophet or a trust?
A7 : Prayer is not valid in a mosque that contains a grave; due to the prohibition of the Prophet (peace and blessings be upon him) from making graves into mosques, and its meaning is that one does not pray at them, whether they are built over or not. This applies if the grave is connected to the mosque or the mosque is built for it. However, if it is separated from it by a street or passage, there is no harm. It is not permissible to swear by other than Allah (Glorified and Exalted is He), neither by the Prophet (peace and blessings be upon him) nor by anyone else; because of his saying (peace and blessings be upon him):Riyad as-Salihin 1711 . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
