Fatwa number ( 13402 )
Q: My father tells me: We pray and fast and know nothing else, and we do not memorize the Qur'an except
Say, "He is Allah, [who is] One,قُلْ هُوَ اللَّهُ أَحَدٌ
[Al-Ikhlas 112:1]
(i.e., Surat al-Ikhlas), and (Surat al-Nas), and he prays with them in every prayer, and there is no harm if he commits an act of shirk or disbelief, as long as he testifies that there is no god but Allah, and that Muhammad is the Messenger of Allah. What is your opinion on this? Is this considered
part of Islam, even though he may commit something that invalidates Islam, or an act of disbelief, such as referring to the taghut for judgment , or making equals for Allah?

A: It is established that the Prophet (peace and blessings be upon him) said:
I have been commanded to fight the people until they say: La ilaha illallah. If they say it, then their blood and wealth are protected from me, except for a right that is due from it, and their reckoning will be with Allah.أمرت أن أقاتل الناس حتى يقولوا: لا إله إلا الله، فإذا قالوها عصموا مني دماءهم وأموالهم إلا بحقها وحسابهم على الله
Sunan Ibn Majah 3927Sahih (Darussalam)
, and referring to other than Allah for judgment while believing that their ruling is better than the ruling of Allah or equal to the ruling of Allah is disbelief in Allah, and an invalidator of the two testimonies. Likewise, making equals and partners for Allah, calling upon them and hoping for them to avert calamity and remove it, or to bring benefit from them, all of this is disbelief that takes one out of Islam, and the utterance of the two testimonies does not benefit him if he persists in acts of disbelief and shirk; because the right of the testimony that there is no god but Allah is to disbelieve in what is worshipped other than Allah, and this was clarified in the other hadith, which is the saying of the Prophet (peace and blessings be upon him):
He who professed that there is no god but Allah and made a denial of everything which the people worship beside Allah, his property and blood became inviolable, an their affairs rest with Allah.من قال: لا إله إلا الله، وكفر بما يعبد من دون الله، حرم ماله ودمه، وحسابه على الله
Sahih Muslim 23a
, and you should clarify the truth to your father, perhaps Allah will guide him.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
