Q4: What is the Committee’s opinion regarding a truck loaded with unlicensed goods? While the driver was on the road, he encountered the gendarmerie, who asked him for the license. They asked for a license for the goods, but he did not have it with him. They then ordered him to direct the truck to the state, i.e., to the state treasury, by seizing the truck and the goods. Finally, they asked the driver to pay a sum of money so that they would leave him, the truck, and the goods alone. Is this money considered a bribe or not?
A4: If the facts are as stated, it is forbidden for the aforementioned driver to pay any amount of money, and it is forbidden for the gendarmerie officers who seized him to demand it from him or accept his offer; because that is bribery and betrayal of trust, due to the generality of the evidence indicating the prohibition of betrayal and bribery, and because of the great corruption and dire consequences involved in it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
