Q: I am the owner of a construction company, and I have a friend who is a manager in a book and school notebook printing establishment. By virtue of his relationship with officials in the Ministry of Education, he is able to obtain construction projects for the ministry. By virtue of my relationship with him, he offers me work in the form of a profit-sharing partnership (mudarabah) or a qirad contract, where he provides the project and I do the work. However, the problem with this matter is that my friend does not obtain the project unless he pays some money so that the project becomes his share, knowing that no one competes with him in taking the project. From my side, as the owner of the company, if I do not deal with him or anyone else in this way, my works and projects will be stalled. Please give us a ruling on this matter, may Allah reward you all with good.
A: What this person you mentioned is doing is of the nature of the forbidden bribe, and the one who commits it or assists in it is cursed. So you must advise him to leave this work, and it is not permissible for you to accept the contract based on the works he obtains in exchange for this bribe; because this is cooperation in sin
