Q: Since I own a private medical analysis laboratory, and this laboratory is located on a main street with more than thirty clinics, and all of these clinics refuse to deal with us; because our laboratory does not give them a percentage on the analyses for the patients they send to us. And I am fully convinced that sustenance is from Allah, and that whoever leaves something for Allah, Allah will replace it with something better for him, and the material aspect is not the only dimension of the issue, the other dimension is that these doctors are tarnishing the reputation of the laboratory in the worst ways, including: that this laboratory is incompetent, new, and the workers in it do not possess sufficient experience, and sometimes it reaches the point of accusing us that we do not perform the analyses at all, and I am not exaggerating if I say
to Your Eminence that I mediate with more than 30 clinics, and I do not receive from them more than one case per week, and it is without the permission of the treating doctor, and that is because they completely control the patient with their lies and fabrications, and as you know, Your Eminence, this involves severe harm, tarnishing of reputation, and material harm, so what I wish to ask is: if I verify that the price I offer is the price of the neighboring laboratories or slightly cheaper, and I give the doctor a percentage of the value of the analysis without any addition to the customary speed of the analysis, and that is in order to repel moral and material harm, is there any prohibition in this or not? And is the issue of the percentage by ordinary means without the buyer's knowledge of it prohibited or not, and is it a bribe or not, and is the money earned illicit or not? And I add to Your Eminence that I tried to convince the neighboring laboratories not to give the clinics a percentage, but to no avail, and I add to Your Eminence that I tried to convince the doctors to refer their patients to us on the condition that we give this percentage as a discount for the patient, but to no avail. Please inform us, may Allah reward you.
A: It is not permissible for the owner of the laboratory to give the doctor who refers patients to him for analysis a percentage of the money; because that is considered one of the forbidden bribes.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
