Q4: I have read and heard a hadith: The Messenger of Allah (peace and blessings be upon him) said: Is this hadith authentic? I have also read and heard a hadith: Sunan al-Bayhaqi 18:465 , is this hadith authentic or not? And what is the ruling on one who listens to these songs, which include all types of music, if his listening to them is not in his home; such as in a car or in the gatherings of others, where he cannot control them?
A4 : Listening to a voice includes the meaning of inclining toward it and paying attention to it, so listening to songs includes the meaning of inclining toward them and paying attention to them. As for hearing, it may be intentional and attentive, in which case it is also called listening and takes its ruling. It may also be unintentional and without attention to the sound, in which case it is not called listening and is not judged by its ruling. Accordingly, listening to the songs mentioned by the questioner, which include all types of music, is forbidden for everyone who pays attention to them, whether male or female, in his home or outside his home; such as in cars and public or private gatherings; because he has a choice in that matter and inclines toward participating in what the Shari'ah has forbidden. Allah the Exalted said:[Luqman 31:6] ,
And the singing mentioned by the questioner is from idle talk, for it is a trial for the heart, luring it toward evil and turning it away from good, and it wastes a person's time without benefit. It falls under the general category of idle talk, and the one who sings and the one who listens to those songs fall under the general category of those who buy idle talk to divert themselves or others from the path of Allah. Allah has condemned that and threatened whoever does it with humiliating punishment. Just as the Qur'an indicated by its generality the prohibition of singing and listening to it, the Sunnah indicated it as well. Among that is the saying of the Messenger of Allah (peace and blessings be upon him):Sahih al-Bukhari 5590 Narrated by al-Bukhari and others of the imams of hadith. Musical instruments are idle amusement and their tools, and among that is singing and listening to it. So the Messenger of Allah (peace and blessings be upon him) condemned those who make lawful fornication, men wearing silk, drinking intoxicants, musical instruments, and listening to them. He associated musical instruments with the major sins mentioned before them, and threatened at the end of the hadith whoever does that with punishment. This indicates the prohibition of playing musical instruments and listening to them.
As for hearing without intention or attention, such as hearing the singing of musical instruments in shops by someone walking on the road, or what passes by in cars, or the sound of singing coming from the houses of his neighbors while he is in his house, without that appealing to him—this is one who is overcome by the situation; there is no sin upon him. He should advise and forbid what is wrong with wisdom and good exhortation, and he should strive to get rid of what he is able to get rid of, within his capacity and the limits of his ability, for Allah does not burden a soul beyond what it can bear. A group of scholars have proceeded by arguing for their point with valid evidence, then following that with hadiths that have some weakness in their chain or in the aspect of their indication of their claim. This does not harm them in the establishment of the original point they sought, for they mentioned that by way of corroboration and citation, not by way of argument and reliance. Among this is what some scholars mention of hadiths in the context of prohibiting singing and listening to it, after establishing it with valid evidence. So, criticizing what was mentioned does not affect the establishment of the prohibition, which was established originally and primarily by the valid evidence they cited first. Among this is: what al-Hakim al-Tirmidhi narrated from Abu Musa al-Ash'ari : that the Messenger of Allah (peace and blessings be upon him) said:. The second is: what Ibn Asakir narrated from Anas : that the Prophet (peace and blessings be upon him) said: Bulugh al-Maram 16:73 And what Ibn Abi al-Dunya narrated in his book on the condemnation of amusements from Ibn Mas'ud , from the saying of the Prophet (peace and blessings be upon him): Sunan al-Bayhaqi 18:465 And what al-Bayhaqi narrated from Jabir , from the saying of the Messenger of Allah (peace and blessings be upon him): Sunan al-Bayhaqi 18:464 And what Abu Dawud narrated from Salam ibn Maskin, from a shaykh who witnessed Abu Wa'il at a wedding feast, so they were playing, amusing themselves, and singing. Then Abu Wa'il removed his turban and said: I heard Abdullah say: I heard the Messenger of Allah (peace and blessings be upon him) say: Sunan Abi Dawud 4927Da'if (Al-Albani). These hadiths are weak; but their weakness does not affect the prohibition of singing and listening to it, because the prohibition is established by other evidence from the Qur'an and the authentic Sunnah. And Allah is the One who grants success. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.

From among my followers there will be some people who will consider illegal sexual intercourse, the wearing of silk, the drinking of alcoholic drinks and the use of musical instruments, as lawful. And there will be some people who will stay near the side of a mountain and in the evening their shepherd will come to them with their sheep and ask them for something, but they will say to him, 'Return to us tomorrow.' Allah will destroy them during the night and will let the mountain fall on them, and He will transform the rest of them into monkeys and pigs and they will remain so till the Day of Resurrection.
ليكونن من أمتي أقوام يستحلون الحر والحرير والخمر والمعازف، ولينزلن أقوام إلى جنب علم، يروح عليهم بسارحة، يأتيهم -يعني الفقير- لحاجة فيقولون: ارجع إلينا غدًا، فيبيتهم الله ويضع العلم ويمسخ آخرين قردة وخنازير إلى يوم القيامةAs for hearing without intention or attention, such as hearing the singing of musical instruments in shops by someone walking on the road, or what passes by in cars, or the sound of singing coming from the houses of his neighbors while he is in his house, without that appealing to him—this is one who is overcome by the situation; there is no sin upon him. من استمع إلى صوت غناء لم يؤذن له أن يستمع الروحانيين في الجنةIf anyone listened to the talk of some people, when they do not like him to do that, then molten led will be poured into his ears on the Day of Resurrection.
