Q: I have a relative whose father is elderly and ill. His urine retention is due to prostate issues, and it has been decided to perform a removal surgery at the patient's own expense. For this reason, the son asked the family for financial assistance but found no response. His father receives a monthly stipend of 1,425 riyals for leading the mosque prayer. The son has a large family and had deposited money in the bank for future needs, but due to his father's condition, he was forced to withdraw it and pay the surgery costs, which amounted to 12,000 riyals. Is it permissible for the son to take 1,000 riyals monthly from his father's stipend until he recovers the amount he withdrew from the bank, or not? It is known that if the son had not taken from his balance, he would have obtained the money only by taking a pledge on his father's debt regarding the stipend, and the pledge would be for 18,000 riyals, clearing 12,000 riyals, and the pledge holder would demand the father grant him power of attorney over the entire stipend until the amount is paid. We hope you will inform us of your opinion on this.
A: What you spent from your own money on the treatment of your father is part of the right he has upon you, and part of your dutifulness and maintaining ties with him. We hope that Allah will reward you for that with abundant reward and great recompense. If your father gives you what you spent on him, or part of it, for his treatment, with his consent, then you may take it. However, demanding from him all that you spent on him, like a creditor demanding from his debtor, is not prescribed and is not fitting in
The right of your father who raised you from childhood, who stayed up for your comfort and happiness, and who spent on you until you grew up and became a man. This is indicated by what was narrated by 'Amr ibn Shu'ayb from his father from his grandfather, who said: A man came to the Prophet (peace and blessings be upon him) and said: My father has seized my wealth. He said:
You and your wealth belong to your fatherأنت ومالك لأبيك
And the Messenger of Allah (peace and blessings be upon him) said:
The best of your provision is what you earn, and your children are part of what you earn.إن أطيب ما أكلتم من كسبكم، وإن أولادكم من كسبكم
Sunan Ibn Majah 2290Sahih (Darussalam)
It was narrated by Ibn Majah in his Sunan, and Imam Ahmad narrated something similar in his Musnad. In another narration from him, a man came to the Prophet (peace and blessings be upon him) to dispute with his father, saying: O Messenger of Allah, this man has needed my wealth. The Messenger of Allah (peace and blessings be upon him) said:
You and your wealth belong to your fatherأنت ومالك لأبيك
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
