Q: I married a second wife, and it has become clear that a man is my first wife’s brother through breastfeeding. My second wife was breastfed by this man’s wife. Is it permissible to keep both wives? Please note that we do not know whether the first instance of breastfeeding was lawful or not, because the mother and the wet nurse have been dead for a long time. As for the second instance of breastfeeding, which involved my second wife, it is lawful and established by five feedings. I ask you to issue a ruling for us, and may Allah reward you with good for Islam and the Muslims.
A: Breastfeeding that establishes prohibition is five feedings or more within the first two years. If the breastfeeding of both your first wife’s brother and your second wife was of this nature, then your first wife’s brother is the father of your second wife through breastfeeding, and your first wife is the aunt of the second wife, because she is the daughter of her brother through breastfeeding. It is not permissible for you to marry both the first wife and her brother’s daughter through breastfeeding. It is established that the Prophet (peace and blessings be upon him) said:Sahih Muslim 1408a , and the Exalted said: [An-Nisa 4:23]
up to His saying:[An-Nisa 4:23] , and the Exalted said: [Al-Baqarah 2:233] , and it is established that the Prophet (peace and blessings be upon him) said: Sahih al-Bukhari 3105 , and it is established from the hadith of Aisha (may Allah be pleased with her) that she said: “Among what was revealed in the Qur’an was: ‘Ten known feedings establish prohibition,’ then it was abrogated by: ‘Five known feedings.’ The Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as it was.” Know that a feeding is when the child holds the breast and then sucks milk from it; if he lets go and returns to suck milk, that is a second feeding, and so on. If the breastfeeding is less than five, or if there is doubt about whether it reached five, there is no prohibition, and marriage is permissible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
