Q: Ifa man proposed to his sister Zura'ah, and he objected to it out of fear that there might be a milk-kinship between them, then he reached an agreement with them to drop the objection in exchange for a sum of money, and he is now asking whether there is anything in this that compromises his religion?
A: If the questioner does not know with certainty or strong probability that there was a milk-kinship between his sister and the man who proposed to marry her, and he only fears that there might be a milk-kinship between them, then his objection to this marriage is unfounded; because the original state is the absence of milk-kinship, and the original state is not contradicted except by what the Shari'ah lifts it, and the questioner did not mention anything that lifts it, and his fear that there might be a milk-kinship between them does not change the original state from what it is. As for his taking money from them in exchange for his refusal to object, that is taking money by falsehood, so it is not permissible for him to take it from them except with their sincere willingness, and on the condition that it is not in exchange for what was mentioned; because the objection in such a case is either valid, in which case it is forbidden to remain silent about it or to refrain from it, and likewise it is forbidden to object to it, or it is invalid, in which case it is not permissible to insist on it or to take compensation for dropping it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
