Q: I have a wife who has a milk-sister. Her husband has passed away, leaving her with five young orphaned children. I wish to marry her in order to take guardianship of the orphans, provide for their maintenance, and clothe them. Is it permissible for me to take her in marriage or not?
A: If it is established that this woman is the milk-sister of your wife, then it is not permissible for you to marry both of them; because of the saying of Allah the Exalted:
Prohibited to you [for marriage] are your mothers, your daughtersحُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ
[An-Nisa 4:23]
until He said:
and that you take [in marriage] two sisters simultaneously, except for what has already occurredوَأَنْ تَجْمَعُوا بَيْنَ الأُخْتَيْنِ إِلا مَا قَدْ سَلَفَ
[An-Nisa 4:23]
, and because it is established from the Prophet (peace and blessings be upon him) that he said:
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.يحرم من الرضاع ما يحرم من النسب

. As for her orphaned children, if you are able to take guardianship of them and do good to them without marrying their mother and without being alone with her, then do good to them in the hope of
reward from Allah. Otherwise, refer their case to the one in authority so that he may take charge of their affairs by providing for them, whether through financial support, placing them in orphanages, or otherwise. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
