Q: A woman’s husband died before he consummated the marriage with her, and she asks: Does she
have to observe the waiting period for widowhood, is she entitled to the bridal gift, and does she inherit from her husband?

A: If a man dies leaving a wife whom he did not consummate, she must observe the waiting period for widowhood, which is four months and ten nights; based on the saying of Allah the Exalted:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Al-Baqarah 2:234]
And if she has a specified bridal gift, she is entitled to what was specified. If it was not specified, she is entitled to the mahr of her like. She inherits from her husband. If he has children, she is entitled to one-eighth if she has no co-heirs. If she has a co-heir, such as another wife or more, she shares the one-eighth with those who share with her. If he has no children, she is entitled to one-quarter if she has no co-heir. Otherwise, she shares the one-quarter with those who share with her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
