Fatwa No. ( 19434 )
Q: A friend of mine said about fifteen years ago: (That this
is the work of specialized human committees
), and after a short time he returned and repented of that statement, which he never publicly declared, but only said to a friend of his, and no third person knew of it to this day, except Allah alone, Knower of the Unseen. My question was not about repentance and the acceptance of repentance, but rather my question was the following: Was his marriage contract affected by that statement he made, and does the marriage contract need to be renewed, or was his marriage contract not affected and remains as it is, and does not need to be renewed? Knowing that he did not separate from his wife, and he did not know that such a statement could be considered apostasy that entails separation between him and his wife, rather he was ignorant of the ruling of his statement in the Shari'ah and what entails from it.

A: The one who said the aforementioned statement in the question, if he said it while sane and of his own free will - then it is considered apostasy from Islam, may Allah protect us from that, but if he repented of it with a valid repentance, then his repentance is accepted, if Allah wills; because Allah accepts the repentance of whoever repents. As for his wife, she is separated from him by virtue of the apostasy. If he repents while she is in the waiting period, she returns to him without a new contract. If her waiting period ends before he repents, then she is separated from him and she is not lawful to him except with a new contract. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
