The fifth question of Fatwa No. ( 9643 )
Q5: If a man commits a transgression against a girl and fathers a child from her, and then marries her, is this marriage considered repentance or not?
A5: Merely marrying her is not considered repentance; rather, repentance is by turning back to Allah, feeling remorse for the zina that occurred, and resolving not to return to zina if the opportunity arises. If they repent with this repentance and then he marries her after her period of purity (istibra') via one menstrual cycle or her giving birth if she is pregnant, and this is done through her legal guardian (wali) with the mahr and her consent, then the contract is valid and she becomes his wife. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
