Q: I am a student at the College of Teachers, and my primary profession is military service. The commander of this military establishment permitted me to enroll in the college for study in exchange for assigning me to evening work instead of daytime work. However, there are matters that have made me doubt the salary I receive from this military establishment, where I have worked for seven years. These matters are: 1 - When I requested the commander to allow me to enroll in the study, he informed me that there is no clause in the regulations permitting this. After one of his close associates interceded for me with him, he agreed to my request and referred me to the officer in charge of scholarship affairs. This officer informed me that it was not possible, but that they would find a way contrary to the regulations: that I go and register at the college as a student and not as an employee, and that they would assign me to evening work. 2 - I did not work in the evening job I was assigned to for more than one night, because my direct supervisor assigned me to another job, knowing that he has the authority from the general commander to do so. 3 - I do not go to work except a few times, which may not exceed two or three times a month, due to the absence of transactions for me to complete. If there are any, I complete them immediately.
4 - One of the conditions for admission to the college is that the student be dedicated to study and not be an employee in any department during the period of study at the college. I signed this due to my difficult financial circumstances, as I am married and living in a rented place, while my family is in another area, and I have no other income besides this salary I receive from this military establishment, which is (6381) riyals, and the college stipend, which is (850) riyals. My question is: Are the salaries I receive from my primary job during my study period at the college—ten months—lawful or forbidden, as well as the stipend I receive from the college? And is my current situation as an employee and a student—as I described—permissible or not? Please issue a ruling, may Allah benefit you and your knowledge.

A: The employee's salary is not lawful for him unless his employment is in accordance with the regulations, and he performs the work he was assigned in the required manner, and he does not neglect it except for an excuse that the regulations permit. Based on this, the money you took from the state and the college in the manner you clarified in the question is not lawful for you. It is obligatory for you to return it if possible. If it cannot be returned, you should give it in charity or place it in a general charitable project, along with
repentance to Allah the Exalted and commitment to truthfulness in speech and action. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
