Q: A disagreement arose between me and my brother-in-law, the husband of my sister, because he insulted me by saying that I was a lecher toward my sister, who is his wife. When I heard this from people who relayed the news to me, I became angry with him and uttered a single word to the effect that I would put my weapon to his head, or else that the interaction between us would be cut off; I would not enter his house, and he would not enter mine. We remained estranged for these two years, not greeting each other. Then mediators came, and I swore an oath by Allah several times that I would not reconcile with him for the rest of my life. Then my uncle, my father’s brother, and his son came and asked me to reconcile, and I accepted on the condition that I seek your ruling on the divorce and the oath by Allah that occurred. I beseech you to issue a fatwa for me. May Allah reward you with good and prolong your success.
A: If the matter is as described, it is obligatory for you to pay the expiation for an oath for your breaking of your oath. The expiation for an oath is: feeding ten poor people from the middle of your food, or clothing them, or freeing a believing slave. If you cannot find the means to do so, you fast for three days. And there is another expiation for your oath of divorce, if your intention was to prevent yourself from
entering his house, not to divorce her. If your intention was divorce, then one divorce has taken place, and it is permissible for you to take her back as long as she is in the waiting period, provided that two previous divorces have not preceded it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
