Question 4 from Fatwa No. (9509) Q4: What is the ruling on a man who swore not to bring his wife into his house by saying: “By Allah, in whom there is no god but He”? Is it permissible for him to take her back?
A4: It is permissible for the man who swore not to bring his wife into his house to take her back, and he owes an oath expiation for breaking it, which is: feeding ten poor people, or clothing them, or freeing a believing slave. If he finds none of these, he must fast for three days. However, if he intended by this oath to divorce her if he brought her into the house, then one divorce takes effect upon her when she enters the house. He may take her back as long as she is in the waiting period, provided he had not divorced her twice before this. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
