The first question of fatwa number ( 17575 )
Q1: A man swore an oath against his brother not to enter his house, then the one who swore died and the one against whom the oath was sworn entered his brother's house, is anything obligatory upon the heirs of the deceased who swore, and is an oath expiation obligatory upon the one against whom the oath was sworn or not?
A1: There is no impediment to your entering the house of your deceased brother who had sworn that you not enter it; because his oath was dissolved by his death, so there is no expiation upon his heirs, and Allah knows best. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
