A person saying, “I swear by Allah and His Messenger”

Machine translationRead the Arabic original
The eleventh question of the fatwa number ( 5611 )
Q 11: Is it permissible for a person to say, “I swear by Allah and His Messenger”?
A 11: It is not permissible; due to the saying of the Messenger (peace and blessings be upon him):
Whoever has to take an oath should swear by Allah or remain silent.من كان حالفًا فليحلف بالله أو ليصمت
Sahih al-Bukhari 2679
and his saying:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirkمن حلف بغير الله فقد كفر أو أشرك
Riyad as-Salihin 1711
.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
