Swearing by a religion other than Islam

Fatwa number ( 19621 )
Q: What is the ruling in Islam regarding one who says: "If I do such-and-such, I will be a disbeliever," and then does that thing repeatedly, knowing that I am diligent in performing the prayers and completing the recitation of the Noble Qur'an? And have the previous good deeds been nullified? From my side, I have pronounced the two testimonies of faith and performed the ritual bath based on my own judgment, and now I live in a state of constant anxiety, knowing that I testify to faith frequently and am diligent in following the recommended practices, acts of obedience, and seeking forgiveness. Please issue a ruling for us, may Allah reward you with good.
A: It is not permissible for a Muslim to swear by a religion other than Islam, due to what is established from the Prophet (peace and blessings be upon him) regarding the prohibition of that. In (the two Sahihs) it is narrated from him (peace and blessings be upon him) that he said:
if he is lying then he is as he said, and if he is telling the truth, his Islam will not be soundمن حلف بملة غير الإسلام كاذبًا متعمدًا فهو كما قال، وإن كان صادقًا لم يعد إلى الإسلام سالمًا
Sunan an-Nasa'i 3772Hasan (Darussalam)
, and if he does what he swore to leave or leaves what he swore to do, he owes an expiation for an oath, along with repentance to Allah and not returning to such an oath. He does not become a disbeliever because of that, and repentance and good deeds are sufficient for him; because of the saying of Allah the Exalted:
But indeed, I am the Perpetual Forgiver of whoever repents and believes and does righteousness and then continues in guidance.وَإِنِّي لَغَفَّارٌ لِمَنْ تَابَ وَآمَنَ وَعَمِلَ صَالِحًا ثُمَّ اهْتَدَى
[Taha 20:82]
, and his deeds are not nullified; because he did not intend disbelief, but rather intended to emphasize to himself by doing something or leaving it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
