The second and third questions of Fatwa No. ( 1653 )
Q 2: What is the ruling on slaughtered animals sold in the markets of countries whose people are not free from shirk (associating partners with Allah), despite their claim of Islam, due to the prevalence of ignorance and bid'ah (religious innovation) paths among them, such as the Tijaniyyah?
A 2: If the matter is as mentioned in the question, that the slaughterer claims Islam, and it is known that he belongs to a group that permits seeking aid from other than Allah in matters that only Allah can resolve, and they seek aid from the dead, such as prophets and those they believe to be awliya (close friends of Allah), for example—then his slaughter is like the slaughter of the polytheists who worshipped al-Lat
and al-Uzza, Manat, Wadd, Suwa', Yaghuth, Ya'uq, and Nasr. It is not permissible for a true Muslim to eat it; because it is carrion. In fact, his state is worse than the state of those people; because he is an apostate from the Islam he claims, due to his turning to other than Allah in matters that only Allah can do; such as guiding a lost person, healing a sick person, and the like of what is attributed to things beyond ordinary causes, such as the secrets and blessings of the dead, and those in the category of the dead, such as absentees whom the ignorant call upon because they believe in their blessings, and that they have special qualities that enable them to hear the supplication of those who seek their aid to remove hardship or bring benefit, even if the supplicant is in the farthest east and the one being called is in the farthest west. And it is obligatory upon the people of the Sunnah who live in their lands: to advise them and guide them to pure tawhid (the oneness of Allah). If they respond, praise be to Allah. If they do not respond after clarification, they have no excuse. As for if the state of the slaughterer is not known, but the majority of those who claim Islam in their lands are those whose habit is seeking aid from the dead and supplicating to them—then his slaughter is judged by the majority ruling, so it is not permissible to eat it.
Q 3: What is the ruling on one who eats from these slaughtered animals, and he is the imam of a mosque? Is it permissible to pray behind him?
A 3 : If the imam of the mosque eats from these slaughtered animals after being clarified to him and the proof being established against him, while he considers eating it permissible—then the prayer behind him is not valid; because of his belief that what Allah has forbidden, namely carrion, is permissible. And if he eats from them after being clarified to him and the proof being established against him, while he believes it is forbidden—then he is an open sinner. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
