A 8: The answer to these matters is that zina is forbidden by the Book, the Sunnah, and scholarly consensus, and so is sodomy. Islam, by forbidding them, also forbids what may lead to them, such as touching or kissing, just as it forbids a woman traveling without a mahram and being alone with a man who is not her mahram. It also forbids following the gaze, as following the gaze may lead to that, and it forbids listening to
songs and seductive voices that arouse sexual desires; to protect and safeguard the Muslim from being led to commit that heinous crime, whether zina or sodomy. The ruling of these applies to the woman who is engaged and the one who is not, except that it is permissible for the suitor to look at the face of his fiancée without touching her or being alone with her; due to the scriptural evidence that has come regarding this. As for the child of zina, his lineage is attributed to his mother, and his ruling is the ruling of all other Muslims, if his mother is Muslim. He is not held accountable nor blamed for his mother’s crime, nor for the crime of the one who committed zina with her; for His saying, the Exalted:
and no bearer of burdens will bear the burden of anotherوَلاَ تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى
[Al-An'am 6:164]
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
