Fatwa number ( 19968 )
Q: About ten years ago, I went to my car while it was parked on a high spot that I had designated for it to start up, as it was out of order. I wanted to check its water, so I opened the hood and refilled the water. I also added oil, thinking it would help warm up the car even if it was running, due to my advanced age and lack of knowledge about cars and their principles. During that time, the car rushed down from the high spot where it was and ran over my grandson, and he died as a result. The running over happened after I had fallen to the ground while trying to stop it. I hope you will issue a ruling on my case and inform me. .
A: If the situation is as you described, then you owe the expiation for accidental killing, which is: freeing a believing slave. If you cannot find one, then you must fast for two consecutive months; because you were the cause of the accident. As for the blood money, the matter should be referred to the court if there is a claim for it.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
