Q: May Allah reward you with all good. It was Allah’s decree that my father was involved in a car accident while he was driving. As a result of the accident, one person died in the car that collided with my father’s. My father, however, suffered a broken leg and was hospitalized for approximately two months, after which he passed away. My question, may Allah reward you with good and have mercy on your parents: Does my father owe fasting or not? And if he does owe fasting, is it permissible for one of his children to fast on his behalf or pay an expiation for him?
A: If your father was the cause of the error or a participant in it, he must pay the expiation for accidental killing, which is: freeing a believing slave. If he cannot find one, it is obligatory for him to fast two consecutive months. It is recommended for one of his guardians to fast on his behalf; for it is established that the Prophet (peace and blessings be upon him) said:Sahih Muslim 1147 . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
