The questioner : May the honor of the Shaykh, peace be upon you and Allah's mercy and blessings, and may Allah greet you. As for what follows: A woman asks about her deceased father who had two slaves in his debt who died in a car accident, so he did not free a slave or fast two consecutive months due to his ignorance of this matter, knowing that he paid their debts. Is it permissible for me to fast two months for each person? Is it possible for me to share this with my relatives? And is it possible to feed sixty poor people for each person?
The Shaykh : Is it the son? The son who is asking?
The questioner : The question is from the woman.
The Shaykh : Yes, the son of the deceased, the woman, I mean. Yes, it is permissible for her to do so, because it is authentically reported from the Prophet (peace and blessings be upon him) that he said:Sahih Muslim 1147. The scholars differed regarding this fasting: whether it is the fasting of Ramadan and others, or whether it is other than the fasting of Ramadan. The most correct opinion, to which we have inclined after studying the evidence of both groups, is that this fasting mentioned in this hadith is other than the fasting of Ramadan, and it includes the fasting of expiation mentioned in the hadith: Sahih Muslim 1147.
Likewise, freeing a slave, whether for fathers or mothers, is like charity or is a type of charity. Therefore, the guardian of the deceased, whether male or female, must perform this. If he is unable to do so and some of his relatives or distant kin assist him, then it is permissible, if Allah wills.
