Fatwa number ( 8354 )
Q: I was driving my car at a normal speed when a man suddenly appeared in front of me; I did not notice him and hit him. He died half a day after the accident. I compensated his family and gave them the blood money (diyah). I asked about the fasting (expiation), and some scholars told me that it is not obligatory, while others said that it is obligatory. We want a satisfactory answer.
A: It is obligatory for one who kills a Muslim, a dhimmi (a non-Muslim under Muslim protection), or a musta'min (a non-Muslim granted safe conduct) by mistake to pay the blood money (diyah) and the expiation, which is freeing a believing slave. If he does not find one, he must fast for two consecutive months,
Allah the Exalted said:[An-Nisa 4:92] , up to His saying: [An-Nisa 4:92] . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

Allah the Exalted said:
And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charity
And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.
