Q1: About nineteen years ago, I had a daughter who was about one or one and a half years old. She was ill, and her older sister had placed kerosene in the lamp, and a little of it remained in the container she was using. The little girl came and drank from it. I am not sure whether the girl drank from it or not, but traces of kerosene were found on her clothes. After that, the girl passed away within two or three days. The doctor I consulted said that her liver was
burned. Is there a sin on me, or on the girl, or not? If there is something on me, how do I act?
A1 : If it is established that the girl’s death was due to drinking the kerosene, then her sister, if she had reached the age of accountability at the time she left the container with the kerosene in it, owes the expiation for accidental killing; because she caused the death of her sister by being negligent in leaving the kerosene within reach of this girl. The expiation is freeing a believing slave, and if she does not find one or cannot afford it, then she fasts two complete consecutive months, sixty days. And she must repent from that. As for if she was not of age at that time, then she owes no expiation.
