Q: About two years ago, I had a baby girl who was about seven months old. While she was sleeping and her mother was breastfeeding her at four in the morning, with the baby in her mother's lap nursing, I found that she had died. There was a spot of blood on her mother's chest, and also blood in her breast due to the vomit that came out of the baby. When we arrived at the hospital, the doctor determined that while breastfeeding, the vomit went back into her throat and she did not receive assistance. Does her mother have to pay an expiation or not?
A: If the situation is as described, then the mother must pay the expiation for accidental killing; because she caused the baby's death by placing the breast in her mouth in the manner described. The expiation is freeing a believing slave. If she cannot find one, then she must fast for two consecutive months, sixty days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
