Q: We have a sunken room, 9 cubits deep so that it is level with the ground, and it has a staircase for entering it. This room is designated for the engine. We dug a new well and took the engine from the sunken room and placed it on the new well, and we wanted to demolish the aforementioned room. One day, I brought a crowbar to identify its location so I could bury it. There was a previous collapsed platform on it. I dug until I found it, and my father was sitting behind me. Then he stood up and sat in front on the edge of the platform (the collapse). Then I struck a blow with the crowbar, and he said to me: "Go, the engineer has come." I said to him: "If Allah wills," and my intention was to strike this
blow and go, but I struck it and its roof collapsed; because the fill was rotten and the termites had eaten it, and its roof fell, and the platform collapsed. My father was on it, and he fell with the debris inside this room. We took him out and admitted him to the hospital. After a week, Allah took his soul. Does anything befall me regarding my father? Please inform us, may Allah reward you with good.
A: If the situation is as described, then you owe the expiation for accidental killing due to your role in your father's death; because his fall into this deep room was due to your striking its roof with the crowbar until its roof fell, and the platform located on the roof, on which your father was sitting, collapsed, and he fell inside that room, and died as a result. The expiation is freeing a believing slave. If you are unable to do so or cannot find one, then you must fast two consecutive months (sixty days) as expiation for causing accidental killing. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
