Q: One day, I placed my young child, who was seven months old, in one of the rooms and gave him a toy, which was a bag from among children's toys. I then left the room to attend to some necessary household tasks. When I returned, I found that the young child had died because of the bag which had wrapped around his face, nose, and mouth. When I moved him, I found that he had passed away. I later inquired, and I was told that I am required to fast. I am a woman who is unable to fast, so I ask Allah, and then you, to send us a convincing answer. May Allah preserve and care for you.
A: This woman is responsible for the killing of this young child, who was seven months old, because she was negligent in giving him this plastic toy and enabling him to play with it, leaving him alone in the room, and going to attend to household tasks until the toy wrapped around his face, nose, and mouth, suffocating him. It was obligatory upon her to protect this child's life and take the necessary precautions by not giving him this toy, as at this age he does not know how to get rid of such a toy or play with it in a safe manner. Therefore, it is obligatory upon this woman to perform expiation, which is freeing a believing slave.
If she does not find one, she must fast for two consecutive months, and nothing else suffices for her, nor is the fasting dropped from her obligation; it remains a debt upon her. If she is able to fast, she fasts. If she is unable to fast until she dies, it is recommended that one of her relatives fast on her behalf; based on the saying of the Messenger (peace and blessings be upon him):
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه
Sahih Muslim 1147
. This woman must also make sincere repentance for this act and not return to such a thing in the future. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
