Q: I traveled with my family to Makkah al-Mukarramah about fifteen days ago, and when I wanted to return to my residence in the outskirts of the city of Bisha
I placed my young children in the bed of my Hilux truck, which is a double-cab model without a mesh fence (just a bed). While I was driving, a strong wind blew and caused my daughter, named Khalud, who was four years old, to fall onto the asphalt, resulting in her death. The question is: Do I or her mother owe an expiation for accidental killing? The truck bed was large enough to accommodate them, and my three children wanted to ride in the truck bed.
A: If you put the aforementioned girl in the car trunk and there was no adult with her to restrain her and hold her from falling, then you owe the expiation for accidental killing, which is: freeing a believing slave, and if you do not find one, then fasting two consecutive months; because you were negligent in this action. And if there was someone with her to restrain her and hold her, but he was negligent until she fell, then the expiation is upon him; because he is the one who was negligent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
