The third question of Fatwa No. ( 6252 )
Q 3: If God forbid, a person is involved in an accident and he dies along with a number of passengers in the car, and he is the driver , is it obligatory for his family or his heirs to pay the blood money to the families of the deceased, and is it obligatory for his family to fast on his behalf or
perform any other act in compensation for that accident?
A 3: If the killing in the accident was accidental due to the driver's negligence, and the driver died along with those who died in the car, then the blood money is obligatory upon the 'aqilah (clan) of the driver for the heirs of those who died in this accident, excluding the driver. The 'aqilah pays the blood money of their deceased relative to the heirs of each victim. It is not obligatory upon the 'aqilah to perform an expiation, such as freeing a slave or fasting, on behalf of this driver. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
