Q: A manwas married, then he divorced his wife. So he brought two men to witness her return, and then he took her back. After a long period of time had passed, it occurred to the divorced man: Did I take my wife back during her waiting period, or not? And was she pregnant at the time of the divorce and the taking back, or not? Knowing that his predominant belief is that he took her back in less than three months. And after he repeatedly asked his wife about her condition, she said that at the time the divorce occurred: "I was pregnant," and at the time of the taking back: "I was pregnant." So on this basis, is her statement considered valid in the Shari'ah, and what is required of me regarding this sudden doubt after such a long period?or not? And was she pregnant at the time of the divorce and the taking back, or not? Knowing that his predominant belief is that he took her back in less than three months. A: If the matter is as described, namely that the divorce occurred while she was pregnant, and the taking back by her husband occurred while she was pregnant with the aforementioned pregnancy, and the divorce was a revocable divorce, then his taking her back is valid, and the wife is his wife. If there is a dispute, they should refer to the Shari'ah court in the country where the man and woman are located. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
