Fatwa number ( 401 )
Q: A man married a woman and then divorced her. He then married another woman, and her family stipulated that if he returned to his first wife, his return to her would be considered a divorce of their daughter. He committed himself to this condition. He asks whether, if he returns to his first wife, his second wife is thereby divorced?
A: As long as the questioner committed himself to the condition with the family of his second wife, which entails that if he returns to his first wife, their daughter is divorced, then if he returns to his first wife, his second wife is divorced; based on his saying (peace and blessings be upon him):
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
