Q: He married his sister to a man after her divorce from a previous husband. Then she fell ill and came to her brother's house, where he treated her. When her husband came to take her, she refused, claiming that she was still under treatment and that the doctor had forbidden her from having intercourse. Her husband suspected that her brother wanted to divorce her so he could marry her to her first husband. So her brother divorced her with three, ten, and one hundred, stating that he absolutely did not think about returning her to her first husband, in order to convince her husband. He mentions that he was truthful when he divorced her in that he did not think about returning her to the first husband. Then her second husband divorced her, and it was not in her brother's calculations that he would return her to the first husband, as he mentioned. Then, afterwards, everyone developed a desire for her to return to her first husband. Will the divorce fall on her brother if she returns to her first husband? Please inform us.
A: If the matter is as you described, that when you divorced her you did not at all think about returning her, nor did you think about returning her to her first husband,
and the desire for her to return to him only arose and occurred after her second husband divorced her—then you do not break your oath in the divorce that occurred from you by marrying her to her first husband. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
