Fatwa No. ( 146 )
Q: I married my cousin’s daughter. After I married her, I heard her mother say that she had breastfed me and my wife when we were young. I inquired about whether breastfeeding makes a relationship lawful or forbidden, and I was told that it makes it forbidden. So I divorced her three times after I had inquired. Had I been told that it made the relationship lawful, I would not have divorced her. I never wanted to divorce her, and my words to her in the divorce were “divorced,” then “divorced,” then “divorced.” This divorce was based on her mother’s words. After I verified with
her mother—because she said she did not breastfeed me, but rather that she took me on her arms and put her breast in my mouth, and that I did not suckle any milk, and that his grandmother, my father’s mother, took him by force before he could suckle—when the children heard this, my daughter’s husband stood up and divorced her hastily before consulting me. Is she lawful for me?

After the Committee read the question, it requested that the questioner bring his wife’s mother to verify the truth of what he had attributed to her. He brought her, and she was asked about it. She answered as follows: “I (M. S. Q. S.) married (A. S. 'A.) while I was a virgin. ('A. S.) has a son named (S. 'A. S.). When this boy was two years old, I married his uncle. I took him, and after I put my breast in his mouth, his grandmother took him from me by force before he could suckle the milk, and she said, ‘Do not breastfeed him.’ He did not suckle from me, neither before this nor after. Then (S. 'A. S.) married my daughter (S. 'A. S. 'A.), and when he heard that I had breastfed him, he hastened and divorced the aforementioned daughter based on that.” End of quote. After the Committee studied the inquiry and the woman’s answer , it wrote the following answer : Since (S. 'A.) divorced his wife (S. 'A. S. 'A.) by saying “divorced, then divorced, then divorced,” and this divorce came from him when he heard from her mother that she said she had breastfed him and his daughter (S), and he inquired and was told that this
breastfeeding makes the relationship forbidden, and that if this breastfeeding had not occurred, he would not have divorced her, and her mother appeared before the Committee and testified that she did not breastfeed him, but rather took him to breastfeed him, and his grandmother took him by force after she had put her breast in his mouth, before he could suckle, if this is the case, then this divorce does not take effect, and this wife remains in the protection of her husband; because he divorced her based on something he believed had occurred, and it was established that it had not occurred. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
